Terms of Service

Last updated: October 24, 2026

1. Who we are. PocketSevens is a service operated from Colombia by its owner, a merchant registered with the Colombian tax authority (“PocketSevens”, “we”). Legal identification details appear on invoices and are available on written request. Contact: contact@pocketsevens.co.

2. What the service is. PocketSevens tracks publicly visible store catalogs and advertising activity across 12 markets and delivers signals (early opportunities, store activity, saturation checks, product files) through a web access, a weekly delivery, an API or an MCP connection, depending on your plan. It is a market-intelligence tool. It is not financial, legal or business advice, and it does not guarantee sales, profits or the performance of any product you decide to sell.

3. Data sources and limits. The information made available through the Service is compiled from publicly accessible sources, including public advertising transparency libraries and publicly visible commercial pages, and is processed, classified and presented by proprietary means. Coverage, depth and frequency vary by market, category and period and may change without notice. Information may be incomplete, delayed, duplicated, misattributed or otherwise inaccurate, and PocketSevens makes no representation as to its accuracy, completeness, timeliness or fitness for any particular purpose. Nothing in the Service constitutes a recommendation to buy, sell, import, advertise or stock any product, and any decision you make on the basis of the Service is made at your sole discretion and risk. PocketSevens does not promise real-time data and does not disclose the methods, systems, parameters or infrastructure used to compile the Service, all of which are trade secrets.

4. Plans and billing. Plans and prices are listed at pocketsevens.co/pricing in USD. Subscriptions are billed monthly in advance through PayPal (or card via PayPal). Each plan covers one market; additional markets are billed as shown on the pricing page. Prices may change for future billing cycles with at least 15 days’ notice by email; the price of an active cycle never changes. Taxes that apply in your country are your responsibility unless the invoice says otherwise.

5. Cancellation. You can cancel at any time from your PayPal account or by writing to contact@pocketsevens.co. Cancellation stops future charges; you keep access until the end of the cycle you already paid. We do not refund partial months.

6. Right of withdrawal (retracto). If you are a consumer, you may withdraw from your first purchase within 5 business days after the payment, as provided by Colombian Law 1480 of 2011 and, where applicable, EU consumer rules. Write to contact@pocketsevens.co within that period and we refund the full amount through the same payment method within 30 days. If you already received a delivery or used the API key during that period, the withdrawal does not apply, because the service has been performed with your consent.

7. Your account, keys and acceptable use. Access credentials, API keys, deliveries and any output of the Service are personal to you or to the legal entity you represent and may not be shared, lent, sublicensed, resold, published or otherwise made available to any third party. You are responsible for keeping credentials confidential and for all activity carried out under them, whether or not authorised by you. You agree not to: (a) access the Service by automated means other than the API or MCP endpoints we provide, and only within the limits of your plan; (b) attempt to reverse engineer, decompile, probe, scan, test or circumvent any part of the Service, its security, its rate limits or the way its data is compiled; (c) use the Service to build, train, benchmark or improve any product or dataset that competes with it; (d) remove or obscure any notice of ownership; (e) use the Service for any unlawful purpose or in breach of any platform’s terms; or (f) use the Service to identify, contact, harass or target any individual. We may suspend or terminate access, without refund, where we reasonably believe this section has been breached, and we may pursue any further remedy available by law.

8. Intellectual property and confidentiality. The Service, including its software, interfaces, visual design, methods, classifications, taxonomies, compiled datasets, documentation and all improvements, is and remains the exclusive property of PocketSevens and is protected by copyright, database, trade-secret and other laws. Subject to your compliance with these Terms and payment of the applicable fees, you receive a limited, revocable, non-exclusive, non-transferable licence to use the information you receive solely for your own internal business decisions during the term of your subscription. No other right is granted by implication or otherwise. Everything you learn about the Service that is not public, including its structure, the way information is categorised, its performance characteristics and any non-public communication with us, is confidential and may not be disclosed without our prior written consent. Names, marks, products and pages of third parties shown in the Service belong to their respective owners; PocketSevens does not claim any affiliation, sponsorship or endorsement by any of them, including the operators of the public sources it draws upon.

9. Feedback. Any suggestion, idea or feedback you give us about the Service may be used by us freely and without obligation to you.

10. Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including changes to or unavailability of public sources, platform policy changes, outages of third-party providers, network failures, acts of authority or natural events.

11. Assignment. You may not assign or transfer these Terms or your subscription without our written consent. We may assign them to a successor entity that takes over the Service, in which case we will notify you.

12. Custom lines. Work that goes beyond a listed plan (a custom catalog, category or business model) is agreed by separate written quote, which prevails over these terms for that work.

13. Availability and support. We aim for 95 % monthly availability but do not guarantee uninterrupted service. Support is by email and WhatsApp on business days, Colombia time. There is no automatic compensation for downtime.

14. Liability. To the extent the law allows, our total liability for any claim related to the service is limited to the amount you paid us in the 3 months before the claim. We are not liable for lost profits, lost sales, ad spend, or decisions you make using the data. Nothing here limits rights that consumer law gives you and that cannot be waived.

15. Changes. We may update these terms. If a change reduces your rights, we notify you by email at least 15 days before it applies. Continued use after that date means you accept the new terms.

16. Entire agreement; severability; waiver. These Terms, the pricing page and any written quote for custom work make up the whole agreement between you and PocketSevens and replace any prior understanding. If any provision is held invalid, the rest remains in force. A failure to enforce a provision is not a waiver of it.

17. Law and disputes. These terms are governed by the laws of Colombia. Disputes go first to a written attempt at agreement; if that fails, to the competent courts of Colombia, unless mandatory consumer law gives you the courts of your own country.
